Judge Moon Rejects Economic Loss Rule Defense In Defective Steel Piping Case

June 15, 2011 -  The economic loss rule, which prohibits recovery of certain damages in tort, is an effective defense in many cases involving allegations of damage as a result of a defective product.  A decision last week from Judge Moon in the Western District shows that there are limitations to the economic loss rule about which every defendant should be aware.  AIU Insurance Co. v.
